HC issues notice to Edu Dept on anomalies in pay scales- 21-Jan-2015

Chennai: The Madras High Court ordered issue of notice to Tamil Nadu Government on a petition to quash a June 1, 2009 Government Order fixing the pay scales and to correct pay anomalies of post graduate grade teachers.

Justice K K Sasidharan ordered issue of notice to P Sanjai Gandhi, Additional Government Pleader on behalf of Finance (Pay Cell) Department and Secretary, School Education Department on a petition by Tamil Nadu Higher Secondary Post Graduate Teachers Association.
    
The Association submitted that there are three categories of teachers in the government schools who teach to students of standards from 1 to 5, BT Assistants who teach to standards 6 to 10, whose qualification is under degree with B.Ed and post graduate teachers with B.Ed degree who take clasess in standards 11 and 12.
     
The petitioner submitted that BT assistants enjoy promotions as Head Master who requires the same qualification as Post Graduate Teachers and the PG Teachers have only one promotional avenue- Higher Secondary School Head Master.
    
The PG teachers get promoted only on seniority basis and therefore most of them do not get promotion but attain superannuation without promotion, the petitioner submitted.
     
The Association submitted that as per a one man commission recommendations, the B.T. Assistants earn Rs 13,900 as salary whereas the PG teachers earn 14,100 and the Government Order fixing the scale of pay which almost the same pay as that of BT Assistants to PG teachers is arbitrary and unreasonable.
     
The association contended that the they had givern several representations to government to "correct" the pay scales and anomalies that have arisen out of the Government Order. As there was no response from the Government, they said they filed a plea in the High court.
