HC seeks reply from Centre, UP on petition against caste-based reservations- 4-Jul-2015

Allahabad: The Allahabad High Court asked the Centre and Uttar Pradesh government to file counter-affidavits on a petition seeking to declare as ultra vires of the Constitution reservation facility extended to members of Scheduled Castes, Scheduled Tribes and Other Backward Classes.
      
A division bench, comprising Justice Rajesh Kumar and Justice Shamsher Bahadur Singh, passed the order on a petition filed by Prabhat Kumar Singh, an advocate who practices law at the High Court.
       
The petitioner has prayed for declaring the existing reservation system as ultra vires of Articles 14 (equality before law), 16 (equality of opportunity in matters of public employment) and 21 (protection of life and personal liberty) and replacing it with a quota of less than 50 per cent of seats in jobs and educational institutions which shall be open to poor candidates from all caste groups.
        
The court has listed the matter after four weeks.
